1. Agreement to Terms

By accessing or using Pitta.lv services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.

2. Products and Services

All products are subject to availability. We reserve the right to discontinue any product at any time. Prices are subject to change without notice. Product images are representative only; actual items may vary due to the handcrafted nature of our products.

3. Orders and Payment

By placing an order, you warrant that you are legally capable of entering binding contracts. We reserve the right to refuse any order without stating reasons. Payment must be received in full before order processing begins.

4. Account Management

You are responsible for maintaining the confidentiality of your account credentials. We reserve the right to suspend or terminate accounts that violate our terms. You must provide accurate and complete information when creating an account.

5. Pricing and Payments

All prices are in USD unless otherwise stated. We reserve the right to modify pricing without notice. Payment processing is handled by secure third-party providers. By making a purchase, you warrant that you have authorization to use the payment method. Promotional codes are subject to our discretion and may be revoked at any time.

6. Shipping and Delivery

Shipping times are estimates only. International orders may be subject to customs duties. We are not responsible for delays due to customs processing or local delivery services. Risk of loss transfers upon delivery to the carrier. Signature may be required for high-value items.

7. Right of Withdrawal, Returns and Cancellations

In accordance with EU Consumer Rights Directive 2011/83/EU, consumers have the right to withdraw from distance contracts within 14 days without giving any reason. The withdrawal period expires 14 days from the day you acquire physical possession of the goods. To exercise your withdrawal right, you must inform us of your decision by a clear statement (e.g., email to legal@simpleinteriorideas.com). You must return the goods within 14 days of communicating your withdrawal. Items must be unused, undamaged, in original condition with all tags attached, and in original packaging. You bear the direct cost of returning the goods. We may reduce the refund to reflect any diminished value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Refunds will be processed within 14 days of receiving the returned goods or proof of return shipment. Original shipping costs are non-refundable unless the entire order is returned. Custom-made, personalized items, sealed goods that are not suitable for return due to health or hygiene reasons and were unsealed after delivery, and items marked as "Final Sale" are excluded from the right of withdrawal. Order cancellations after processing has begun may incur administrative fees up to 15% of the order value.

8. Product Warranty, Legal Guarantee and Disclaimers

In addition to any commercial warranty, EU consumers are entitled to the legal guarantee of conformity for a period of two years from delivery, as provided under EU Directive 2019/771. Under this legal guarantee, if goods are found to be defective or not in conformity with the contract within two years, the consumer may request repair, replacement, or an appropriate price reduction. We also offer a 30-day commercial warranty covering manufacturing defects. This commercial warranty does not cover: natural variations in materials (including wood grain, stone patterns, and handcrafted imperfections which are characteristics, not defects), normal wear and tear from regular use, damage caused by improper use, modification, or failure to follow care instructions, or color variations from digital representations due to monitor calibration differences. Warranty claims require proof of purchase. The decision to repair or replace is at our discretion. This commercial warranty is in addition to, and does not affect, your statutory rights under EU consumer law.

9. Intellectual Property Rights

All content, including images, text, logos, and designs, is our exclusive property. No content may be reproduced, modified, or distributed without written permission. Product reviews and feedback may be used by us for promotional purposes. User-submitted content must not infringe on third-party rights.

10. Privacy and Data Protection (GDPR)

We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and Latvian data protection laws. The legal basis for processing your data includes: contract performance (to fulfill your orders), legitimate interests (fraud prevention, service improvement), legal obligations (tax and accounting requirements), and consent (where specifically requested). Under GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. You may withdraw consent at any time without affecting the lawfulness of prior processing. To exercise these rights, contact us at legal@simpleinteriorideas.com. We implement appropriate technical and organizational security measures to protect your data. While we take reasonable precautions, no internet transmission is completely secure. Data may be transferred to third-party processors (payment providers, shipping carriers) necessary to fulfill your orders, all of whom are bound by GDPR-compliant data processing agreements. You have the right to lodge a complaint with the Latvian Data State Inspectorate (Datu valsts inspekcija) or your local supervisory authority.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia and applicable European Union regulations. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Riga, Latvia. Before initiating any formal legal proceedings, you agree to first attempt to resolve disputes informally by contacting us at legal@simpleinteriorideas.com. We will attempt to resolve the matter within 30 days. If informal resolution is unsuccessful, either party may proceed with formal proceedings. For consumers residing in the EU, this clause does not affect your statutory rights under applicable consumer protection laws or your right to bring claims in your country of residence.

12. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability for any claims arising from or related to these Terms or your use of our services shall not exceed the total amount paid by you for the specific product or service giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages. We are not liable for delays or failures in performance resulting from force majeure events, including but not limited to natural disasters, wars, terrorism, pandemics, government actions, labor disputes, or supply chain disruptions. These limitations do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable EU consumer protection laws.

13. Fraud Prevention & Fair Usage Policy

We actively monitor all transactions and account activity to prevent fraud and policy abuse. By placing an order, you agree to our Fair Usage Policy. We reserve the right, at our sole discretion, to: refuse or cancel any order; limit or cancel quantities purchased per person, household, or order; restrict or terminate account access; withhold refunds pending investigation; and pursue legal remedies for confirmed fraud. Fraudulent activities include but are not limited to: filing false chargebacks or payment disputes; providing inconsistent, contradictory, or false return reasons; excessive return rates indicating abuse; "wardrobing" (using and returning items); returning empty boxes, different items, or counterfeits; creating multiple accounts to circumvent restrictions; exploiting pricing errors or promotional codes; and providing false personal or payment information. Confirmed fraudulent activity results in permanent account termination, potential civil and criminal prosecution under Latvian law, reporting to fraud prevention networks and law enforcement, and recovery of all losses including products, shipping, chargeback fees, and legal costs. All fraud determinations are made at our sole discretion based on available evidence. Our decisions are final, subject only to mandatory consumer protection laws. 14. Website Use and Security

You agree not to use automated systems without permission. We may monitor usage for security. You must not attempt to breach security measures. Website availability is not guaranteed. We reserve the right to restrict access based on geographic location.

15. Modifications to Terms

We may modify these terms at any time without individual notice. Changes are effective immediately upon posting. Continued use constitutes acceptance of modified terms. Material changes may be announced through our website or email.
